HAAH Automotive Holdings Inc. (“HAAH”) is committed to the protection of your personal information. “Personal information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“Personal Information”). We want you to understand your rights under the law when it comes to Personal Information. If you are a California resident, you can make certain requests regarding your Personal Information. We will fulfill each of these requests to the extent required by law.
Under California’s “Shine the Light” law, California residents who provide Personal Information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once per calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediate prior calendar year (e.g., requests made in 2020 will receive information regarding 2019 sharing activities).
We share customer information with other businesses within our corporate family. We also share customer information with others outside of HAAH for direct marketing of their products only if we have your affirmative consent (opt in). You may ask us for more information about this sharing and whether it affects you by contacting us at the address below.
Under the California Consumer Privacy Act (“CCPA”), California residents also have the following rights related to Personal Information effective January 1, 2020:
1. Right to Know and Access Your Personal Information:
In the event you exercise your right to know what Personal Information we collect and share about you and/or your right to access your Personal Information, we will comply to the extent required by law by providing the following:
You can ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the Personal Information we collected about you in the previous 12 months.
2. Right to Delete Your Personal Information:
You have the right to ask that we delete your Personal Information. Once we receive a request, to the extent required by law, we will delete the Personal Information from our records we hold about you as of the date of your request and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your Personal Information, you may not be able to use certain website or in-store functions that require your Personal Information to operate. Otherwise, deleting your Personal Information will not affect your services with us.
3. Right to Request That We Stop Selling Your Personal Information:
We do not sell your Personal information for monetary consideration. However, under some circumstances, a transfer of your Personal Information may be made to a third-party service provider or corporate affiliate, without monetary consideration. Such transfer may be considered a “sale” under California law. If you submit a request to stop selling your Personal Information, we will stop making such transfers. If you are a California resident, to opt-out of the sale of your Personal Information, click “Do Not Sell My Personal Information” at the bottom of our home page to submit your request.
4. Right to No Discrimination:
We will not discriminate against you for exercising your rights. This generally means we will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality for goods. However, please understand that if you ask us to delete your Personal Information, it may impact your experience with us.
Any request to exercise any of your rights under the California Consumer Privacy Act must contain sufficient information for us to verify your identity. We ask that you provide two (2) data points of information that we will match to the information we know about you in order to verify your request for the general categories of Personal Information that we have collected about you or your request to delete any Personal Information. We will only disclose the specific pieces of information that we have collected about you or proceed to delete Personal Information after matching at least two (2) data points to the information we know about you.
If you choose to make a request by e-mail, please provide your full name and your e-mail address, home and/or business address, and the phone number we would have in our records so that we are able to verify that you are the person about whom we collected Personal Information. Your e-mail should also describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. Do not send your social security number, credit card number, passport number, or other identification card number when you submit your request. The Personal Information you provide with your request will only be used to verify your identity.
We cannot respond to your request or provide you with your Personal Information if we cannot verify your identity and confirm the Personal Information relates to you for your own protection and to comply with relevant law.
We will confirm receipt of the request within ten (10) days of its receipt. We endeavor to respond to requests within forty-five (45) days of receipt. If we require more time (up to an additional forty-five (45) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding receipt of the request.
HAAH has collected the following categories of Personal Information in the preceding 12 months:
Categories of Personal Information for a Business Purpose: We share certain categories of Personal Information for a business purpose including identifying information, demographics, social media information, internet and other network activity information, location information, device information, inferences, audio and visual information, and other information that you provide.
Categories of Personal Information Disclosed: We collect dealer information and disclose that dealer information to third party marketing companies.
